STATUTE:Chapter
60. Motor Vehicles. Article 6. Nebraska Rules of the Road (W) Helmets.
Section 60-6, 279. Protective helmets; required; when.:
"A person shall not operate or be a passenger on a motorcycle
or moped on any highway in this state unless such person is wearing
a protective helmet of the type and design manufactured for use
by operators of such vehicles and unless such helmet is secured
properly on his or her head with a chin strap while the vehicle
is in motion. . . ."
STANDARDS:
Chapter 60. Motor Vehicles. Article 6. Nebraska Rules of the Road
(W) Helmets. Section 60-6, 279. Protective helmets; required; when.:
". . . protective helmets shall be designed to reduce injuries
to the user resulting from head impacts and shall be designed to
protect the user by remaining on the user's head, deflecting blows,
resisting penetration, and spreading the force of impact. Each such
helmet shall consist of lining, padding, and chin strap and shall
meet or exceed the standards established in the United States Department
of Transportation's Federal Motor Vehicle Safety Standard No. 218,
49 C.F.R. 571.218, for motorcycle helmets."

NEBRASKA: DISCRIMINATION
ON THE BASIS OF CLOTHING OR CLUB MEMBERSHIP IS ILLEGAL
Nebraska Statute Section 20-148
makes it a crime to deny the full and equal enjoyment of any public
place of accommodation due to unfair and unconstitutional discriminatory
activity. This section specifically states that "any person
or company... who subjects or causes to be subjected any citizen
of this state or other person within the jurisdiction thereof to
the deprivation of any rights, privileges, or immunities secured
by the United States Constitution or the Constitution and laws of
the State of Nebraska, shall be liable to such injured person in
a civil action or other proper proceeding for redress brought by
such injured person." In addition, any person whose exercise
or enjoyment of rights secured by the Constitution or laws of the
United States has been interfered with or attempted to be interfered
with institute and prosecute a civil action for injunctive and other
appropriate equitable relief including the award of compensatory
monetary damages, The Supreme Court ruled in the case of Cohen v.
California, 403 U.S. 15 (1971) that individuals have the constitutional
right under the First Amendment to wear clothing which displays
writing or designs. A citizen has the right to move freely and peaceably
in public places, without fear of being discriminately removed therefrom
In addition, the right of an individual to freedom of association
has long been recognized and protected by the United States Supreme
Court Thus, a person's right to wear the clothing of his choice,
as well as his right to belong to any club or organization of his
choice is constitutionally protected and persons or establishments
who discriminate on the basis of clothing or club membership are
subject to lawsuit.
