Missouri Motorcycle Helmet Law

Missouri has full motorcycle helmet laws for all motorcycle riders!

STATUTE: Title XIX. Motor Vehicles, Watercraft and Aviation. Chapter 302. Drivers' and Commercial Drivers' Licenses. Section 302.020. Operation of Motor Vehicle Without Proper License Prohibited -- Motorcycles -- Special License -- Protective Headgear -- Penalty. : 
". . . 2. Every person operating or riding as a passenger on any motorcycle or motortricycle, as defined in section 301.010, RSMo, upon any highway of this state shall wear protective headgear at all times the vehicle is in motion. . . ."

FINE: Title XIX. Motor Vehicles, Watercraft and Aviation. Chapter 302. Drivers' and Commercial Drivers' Licenses. Section 302.020. Operation of Motor Vehicle Without Proper License Prohibited -- Motorcycles -- Special License -- Protective Headgear -- Penalty. : 
". . . 3. Notwithstanding the provisions of section 302.340, the penalty for failure to wear protective headgear as required by subsection 2 of this section shall be an infraction for which a fine not to exceed twenty-five dollars may be imposed. Notwithstanding all other provisions of law and court rules to the contrary, no court costs shall be imposed upon any person due to such violation. No points shall be assessed under section 302.302 for a failure to wear such protective headgear."

MISSOURI: DISCRIMINATION ON THE BASIS OF CLOTHING OR CLUB MEMBERSHIP IS ILLEGAL

The Missouri Human Rights Act states that all persons within the jurisdiction of the state of Missouri are free and equal and shall be entitled to the full and equal use and enjoyment within the state of any place of public accommodation without discrimination or segregation on the grounds of race, color, religion, national origin, sex, ancestry, or handicap. RSMO 5213.065. Places of public accommodation is defined as "all places or businesses offering or holding out to the general public, good, services, privileges, facilities, advantages or accommodations for the peace, comfort, health, welfare and safety of the general public or such public places providing food, shelter, recreation and amusement...." RSMO 213.010(11). Any person whose exercise or enjoyment of rights secured by the Constitution or laws of the United States has been interfered with or attempted to be interfered with may bring a complaint to the Missouri Commission on Human Rights. The Supreme Court ruled in the case of Cohen vs.. California, 403 U.S. 15 (1971), that individuals have the constitutional right under the First Amendment to wear clothing which displays writing or designs. In addition, the right of an individual to freedom of association has long been recognized and protected by the United States Supreme Court. Thus, a person's right to wear the clothing of his choice, as well as his right to belong to any club or organization of his choice, is constitutionally protected, and persons or establishments who discriminate on the basis of clothing or club membership are subject to lawsuit.
